We’re still not clear on whether Psystar is still in business, or if it’s selling anything other than T-shirts, but the would-be Mac cloner isn’t totally out of the game yet: it’s filed an official notice of appeal in the California court, which means it’s going to try and fight that decisive victory and injunction won by Apple a month ago. Just based on the simple open-and-shut legal reasoning involved in the decision — surprise, you can’t copy, modify, and resell a copyrighted work without permission — we’d say this appeal is a long shot, but we didn’t go to Harvard Law School like Psystar attorney Eugene Action. Man, we missed that guy. Let’s quote from his website again, shall we?

The matrix is born and the energy sucking machine herds Americans into pods of predetermined limitations. Forced programming on your computer is just one of the provisional patents looming against freedom and democracy. Capitalism spurring innovation and creativity through open and competitive markets is at risk on this new frontier. This new battle is being fought on the abstract electronic plains of America while most of us cannot even open our email. The beachheads are red with the blood of ambitious Americans gunned down for their initiative.

Let’s be honest: we never, ever, want this story to end.

P.S. — Wondering why Rebel EFI is listed as “out of stock” on the Psystar website? It’s because there isn’t any stock, shockingly enough — in a statement filed with the court on December 31, Rudy Pedraza says all copies of the bootloader have been destroyed except for one that’s in the possession of his attorneys. Between this appeal and the pending case in Florida over Snow Leopard, we’d say that means it’ll be a long time before the software is back on the scene — enough time for the legit OSx86 scene to leapfrog it entirely.

May not prevent sale of Mac clones
Psystar and Apple strike Mac clone deal

In an unusual twist to the long and winding saga of Psystar, Computerworld is reporting that Apple and Psystar have come to an amicable settlement that may not prevent the tiny Florida company from selling its Mac clones.

Psystar offered the tech giant the compromise of shifting the responsibility for installing the OS onto the customers. Psystar would then sell computers bundled with its $50 “Rebel EFI” app to customers, but without a copy of OS X, which they’d have to find elsewhere.

The customers wouldn’t then be liable, Psystar claims, because they wouldn’t be installing OS X for commercial usage. Psystar’s installation of the software does count as commercial usage, as it sells the machines. Apple hasn’t commented on this claim.

In return for this concession from Apple, Psystar would pay unspecified damages, but crucially be able to continue its business of selling cheap computers that run OS X – something Apple has always refused to do.

It might not save the company, however. Despite promising investors sales of 70,000 or so, Psystar only sold 768 machines between April 2008 and Mid-August 2009. Apple sells that quantity of machines every 40 minutes.

Wants back what it overpaid
Nokia sues 11 LCD manufacturers over price-fixing

Nokia is suing a range of manufacturers to get back what it overpaid for displays up to 2006, thanks to illegal price-fixing rackets in the LCD and CRT markets.

Samsung, LG, Sharp, Philips, Hitachi, Toshiba and others – some of which have been found guilty, and fined in the US, for fixing prices of LCD displays – are named in the lawsuit.

Nokia has not revealed at this stage how much it wants repaid, but considering the volume of Nokia’s handset manufacturing, it’s likely to be considerable.

The lawsuits have been filed in both the US and the UK, with the UK’s suit also encompassing CRT displays.

This news follows Nokia suing Apple for alleged iPhone patent infringements, with the cases suggested by some as a way for Nokia to raise revenue.
